Pluto Advertising Guidelines and Policies
- Blind Sales and Reporting. All ad inventory made available to Partner pursuant to an agreement referencing these Guidelines shall be sold and reported on a run of service and “blind” basis only (i.e., not sold specifically against or in connection with the Pluto Service, any content appearing thereon or any other Pluto Marks, Pluto brands, programming franchises, specials or marquee events) and except as otherwise set forth herein, Partner shall not identify, promote or make reference to Pluto Service, any content appearing thereon or any other Pluto (or Paramount Global) Marks, Pluto (or Paramount Global) brands, programming franchises, specials or marquee events in any sales collateral or delivery or post-sale reporting. Partner shall obfuscate any bid stream identifiers as the source of inventory made available hereunder.
- Pluto Policies. Partner will deliver ads in accordance with the Pluto Policies. Pluto reserves the right to reject or remove any ads (or suspend sending ad requests) that do not comply with the Pluto Policies or any applicable laws, rules or regulations or if such ads are causing technical issues with the Pluto Service. “Pluto Policies” means the advertising criteria or specifications provided by Pluto to Partner or made available on a site, including content limitations, technical specifications (including use of ad tags, pixels, JavaScript, cookies, and other technology now known or hereafter developed that is designed to track users’ online behavior or activity). The term “Pluto Policies” will also include any modifications or new policies, including to these Guidelines, that Pluto may promulgate from time to time.
- Additional Restrictions. Notwithstanding anything to the contrary contained herein or in the Pluto Policies, without the prior written consent of Pluto, in no event shall advertisements used or sold by Partner into the Partner Ad Inventory contain any content (i) for religious programming, 900 numbers, X-rated material, habit-forming drugs, drug related paraphernalia, tobacco products, firearms, distilled liquor, any adult-oriented products or services (including, without limitation, adult-oriented pay per view programs, specials or events), salacious products or services or other material which would generally be considered obscene or indecent, or any other activity that Partner knows or reasonably should know contravenes any applicable laws, (ii) inducing, promoting, or facilitating copyright infringement (e.g., advertisements that return as sponsored links to the search term “download free movies”) or selling, promoting, distributing or otherwise making available any goods or services that enable or facilitate the circumvention of copy protection technologies (e.g., DVD ripper software) or (iii) advocacy, alcoholic beverages, for adult material (including sex toys, chat/text lines, girlie wallpapers, DVD’, Erectile Dysfunction medication and male enhancement, bust enhancement), dietary supplements, e-cigarettes, gambling, M-rated video games, political matter, red band trailers, religious matter or weight loss products. Partner acknowledges and agrees that Pluto reserves the right to cancel, reject, and/or direct Partner to remove any advertising assets that do not comply with the restrictions in these guidelines in Pluto’s good faith discretion. Partner will comply with any removal request from Pluto as soon as possible but in no event later than one business day following receipt of the request by Pluto.
- Block List. Pluto shall have the right to establish a block list of advertisers (the “Block List”), which may be updated by Pluto from time to time. Partner shall not (i) run advertisements in the Partner Ad Inventory to any advertiser appearing on the applicable Block List provided by Pluto or (ii) display any creative in inventory made available hereunder from or related to any advertiser appearing on such Block List. An initial Block List shall be made available upon request. Updates to the Block List shall be implemented within ten (10) days following provision by Pluto in writing. In addition to the Block List, in no event shall Partner use impressions made available hereunder to run advertisements for any news, broadcast or cable services or streaming services that are competitive to Paramount Global, including, without limitation, services offered by NBCUniversal, Fox, Warner Bros. Discovery, and Disney (the “Competitive Services”).
- Additional Restrictions. Partner acknowledges and agrees that from time to time during the term, additional restrictions and limitations may apply to specific content in the Pluto Service not reflected in the Block List. Pluto will make best efforts to provide Partner with advance notice of any such advertiser restrictions specific to certain content whenever possible (e.g. an exclusive sponsorship), provided, however, that if Pluto requests an advertisement be removed from a Pluto Service after the campaign has started, Partner shall promptly remove such advertisement following notice.
